BTO SUR assisted to draft a statement of claim

The Baltic Territorial Organization of the Seafarers' Union of Russia does a lot of work in terms of providing legal assistance to seafarers and their families. The most issues addressed to the Union relate to working conditions on board. In particular, a crew member of a Russia-flagged vessel faced back wages for several months. The seafarer turned to the lawyers of BTO SUR to clarify the list of documents required for filing a statement of claim to a court.

BTO SUR notes that everything must be based on the merits of the issue, or else the claim will be rejected. In case of the back wages, the list of required documents includes a duly executed employment contract (employment agreement) stipulating detailed working conditions; a collective agreement, if the provisions of such a document apply to crew members; a ship's payroll; a Seafarer's ID; a certificate of seafarer service on ship, as well as a certificate of outstanding amounts (deposit certificate).

After thoroughly examining all the circumstances of the dispute, the trade union specialists assisted the seafarer in drafting a statement of claim to a court.
