Repatriation costs during the probationary period are paid by the party initiating the termination of the contract

A crew member of MV Grand T turned to the Seafarers' Union of Russia for assistance when he found out that the company was planning his signing-off prior to the end of the contract. The employer explained that he was dissatisfied with the seafarer's performance.

The seafarer wanted to clarify with the Union whether he was entitled to a financial compensation due to the early termination of the contract by the company. Also, he wished to know who should bear the repatriation costs. Besides, he was worried about the payment for the time worked.

According to SUR, the crew member was on a probationary period. The compensation isn't provided in this case, unless the contract stipulates otherwise.

However, as for the repatriation costs, in this case it is definitely the responsibility of the shipowner. Indeed, the company paid travel expenses and repatriated the seafarer. Besides, he received a final payment of $9,000 for the period worked.

SUR reminds: a collective agreement is the main protection during a voyage. This is, as well, evidenced by unforeseen situations seafarers face.
