Lawyer of FETO SUR won three court cases for the seafarer’s family

On Tuesday, the third court hearing on the claim of the daughter of the seafarer who died on board of trawler t Prostor (flag of the Russian Federation) ended in Nakhodka. The Nakhodka court decided to recover 1 million rubles of moral compensation in her favor from the joint-stock company DMP-RM. The interests of the woman were represented by the lawyer of the Far Eastern territorial organization of the Seafarers Union of Russia, Vasiliy Savelyev. By the way, this is his third victory in a case related to the death of a sailor on a trawler.

Recall that the tragedy occurred on January 6, 2019, when, in a storm, the ship was fishing for pollock in the area of the West Kamchatka subzone. The seafarer’s daughter said that her father was working on the open part of the fishing deck in the aft part of the ship when, coming out of the right aft pocket and stepping over the structural fence (coaming), he stumbled on the slip roll and fell into the water. After the search measures taken, he was found on the surface of the water without signs of life, and when trying to lift him to the deck, the body slipped out of the life jacket and warm jacket and went under the water. Further searches brought no results.

«The relatives of the sailor have a legal right to demand compensation from the employer for moral damage. It is enshrined in Article 1079 of the Civil Code of the Russian Federation», - said Vasiliy Saveliev.

Thus, legal entities and citizens whose activities are associated with increased danger to others are obliged to compensate for the damage caused by the source of increased danger, unless they prove that it arose as a result of force majeure or intent of the victim.

The first trial related to the death of a seafarer took place back in September 2019. The trial lasted 11 months, culminating in the victory of the lawyer of the FETO SUR so the widow of the sailor received compensation for moral damage in the amount of 1 million 300 thousand rubles. Another hearing was held in June last year on the widow's claim in favor of the deceased's minor son. According to the court's decision, the amount of compensation amounted to 1 million rubles.

Thus, the total amount of damage compensated amounted to more than 3 million rubles.

The relatives of the seafarer’s warmly thanked the Seafarers Union of Russia for moral and legal support and assistance in obtaining compensation.
