SUR appealed to the Ministry of Internal Affairs to check the performance of Navis Shipping JSC

Recall that last week, the Far Eastern territorial organization of the Seafarers Union of Russia was contacted by the seafarer Magomed Ziyavdinov, who served as a Ch. Officer on board the vessel Socol 9 from July 31, 2020 to February 20, 2021. He got the job on the ship, which is managed by the Singapore shipowner Navis Car Line Pte. Ltd., through the crewing agency Navis Shipping. At the same time, according to the seafarer, agency committed serious violations, in connection with which the SUR appealed to the main department for Migration of the Ministry of Internal Affairs of Russia.

So, Magomed Ziyavdinov said that when he was employed, he was charged $300 for Panamanian flag endorsement to work, which is illegal. Thus, according to paragraph 5 of the Regulations on licensing activities related to the provision of employment services for citizens of the Russian Federation outside the territory of the Russian Federation, a number of requirements are imposed on the licensee that comply with the provisions of the Maritime Labor Convention.

In particular, we are talking about the exclusion of the possibility of paying seafarers directly or indirectly for commissions and other costs related to employment or the provision of a workplace, except for the costs that he bears in connection with obtaining a seafarer's identity card, a seaman's book and passing a medical examination.

In addition, the licensee must provide compensation to the crewmembers for monetary damage that they suffered as a result of the shipowner's failure to fulfill his obligations to them, in accordance with the employment contract. According to Ziyavdinov, the foreign employer did not pay him part of the salary, 2600 US dollars, but Navis Shipping did not reimburse the money.

As noted by Nikolay Sukhanov, chairman of the FETO SUR, the seaman was not provided with information about the terms of employment, although in the contract was mentioned that he was familiar with these documents.

Based on paragraph 2 of part 10 of Article 19 and paragraph 2 of part 11 of Article 1 of the Federal Law On Licensing of Certain Types of activities, the SUR requests the main Directorate for Migration of the Ministry of Internal Affairs of Russia to conduct an unscheduled inspection of the licensee of Navis Shipping JSC and oblige to eliminate violations of licensing requirements, if they are detected.
