A criminal case has been opened on the fact of an accident on board

The circumstances of the accident on board the trawler Kalynovka, in result of which a seafarer lost his left hand, has been investigating the investigating bodies of Far East Transport investigation department of Investigative Committee of the Russian Federation. The criminal proceedings were brought into an offence under article 125 of the Criminal code of the Russian Federation, e.g. failure in giving assistance to persons in danger. Recall that in February this year, the Far Eastern regional organization of the Seafarers Union of Russia sent a request to the State labor Inspectorate of the Primorsky territory and the Bolshekamensk Interdistrict Prosecutor's office to check the legality of the actions of LLC RK Novy Mir regarding investigation of the incident of board of  Kalinovka . The request was delivered after the victim applied for the trade union for assistance.  He said that on January 14, 2020, while fishing in the sea of Okhotsk, when setting a trawl, he suffered an injury to his left thumb. After 40 minutes, he was transferred to the Bay Vostok floating base for medical treatment, where the ship's doctor conducted left-hand therapy for 10 days. Upon arrival in the port of Nakhodka, he was admitted to the city hospital, where after several operations it turned out that it was impossible to stop the inflammatory process. As a result, doctors amputated the seafarer's left arm. According to investigators, the seafarer was injured as a result of a break in the stopper of the trawl board. At the disposal of the investigative authorities there are the materials of the investigation of an accident at work conducted by the shipowner. According to the act, the main cause of the incident was personal negligence of the victim. However, the Department notes that the conclusions reflected in the document are subject to a comprehensive assessment during the investigation of the criminal case. Investigators also thoroughly and objectively investigate the victim's arguments about the failure to take measures to bring him to the hospital ashore and the reasons for which the seafarer was injured.  Currently, the criminal case is being investigated; its progress and results are under the control of the investigation Department. For its part, the DVRO SUR will continue to monitor the situation. Chairman of the organization Nikolay Sukhanov said: «We are surprised that the seafarer was not sent to the hospital in Magadan, though the vessel was near the port. Instead, he was transported to Nakhodka and it took more than a week. Perhaps the lost time could have caused the amputation of the left arm. That is why, back in February, we applied to the Labor Inspectorate and the Prosecutor's office to check the legality of the employer's actions. If the essential elements of offence in the actions are found, we asked to transfer the materials for initiating a criminal case to the court, which, in fact, happened."
